Paternal rights for an out-of-state deadbeat dad?
What kind of rights does an out-of state deadbeat dad, have in the life of his biological child here in new jersey? I want to adopt my stepdaughter but am afraid the biological father wil refuse to give up parental rights out of spite, even though he has not seen her in 3 years (she's six now). she doesn't really remember him at all, and never metions him. With minimal monetary resources we , my wife and I , could not afford a long drawn out court battle, only minimal attorney fees. thank-you

Fair or not, in most cases our law would give this deadbeat dad the right to reject your attempts to adopt. However, you should know relatively quickly what his position will be. My suggestion is that you retain a lawyer to write him a simple letter to attempt to ascertain his position. If he says he wants to maintain his paternal rights, you wouldn't go any further.
