Legal Question in Family Law in New Jersey
I reside in New Jersey with my fianc� and we are both females in a same sex relationship. I have a son and her 2 daughters. She recently sent her daughter who is 7 to spend time with her family in St. Louis for the summer. Once she got to her dads he called cps and had them sent to my home because he states that I choked his daughter and threw her up against the wall. Also stated that my 10 year old son told her perform oral sex on him. These are false allegations since he is trying to get her away from her mother due to our relationship. He is not even listed as her father on the birth certificate nor does he pay support. He now has not allowed her contact with her mother in a week. Cps talked to the mother here in jersey but I was at work so now they just need to speak with me and my son to complete the investigation. By law can she just go to Missouri and get her child cause she is still a resident of New Jersey?
