Self-employed spouse hiding income-employer helping her
My spouse is an independent life/health insurance agent and works with an agency who has contracts with life insurance company, and my spouse gets her fixed % commission directly from the life insurance company, with a separate percentage directly going to the agency. My attorney sent a subpoena to the agency asking them about any payments paid to my spouse in any form, ex.,expenses, ect., and specific question about a public award,in my presence,during Christmas, for highest producer in the agency with premium amount of $128000 for the year. The 1099-misc received from the insurance company showed approximately 60% of income expected from the premium announced in the award. I suspect the agency owners,who are good friends of spouse, are showing some of my spouse's business under their name and paying the amount to my spouse under the table. The agency simply declined to respond to any of the specific questions, stating that commisions are directly paid by insurance company, and we should contact the insurance co, which is not much use since they officialy show an amount equal to 1099-misc. I do not have resources to fight an agency.My spouse is looking to big alimony based on her false income. What can I do? Please help.

You need an attorney that is going to fight them as much as possible with every tool available. You have to hit them with everything you got to get what you need. If you don't spend more now on a good attorney, it sounds like you will pay a lot more later.

If you are looking for assistance on a computer bulletin board, then something is going wrong here. If you can not get a straight answer and a game plan from your attorney, then get another attorney.
