My sons mother is using his idenity for utility bills, can I get custody

Custody issues are always decided in the best interests of the child. I suppose your argument is that your son's mother is committing a crime or fraudulent act of some type. Not sure if a Judge would consider those acts, without a conviction, as something that would impair her ability to be a good parent since even some people with convictions have custodial rights. However, it may be one factor under consideration with all other factors when the custodial decision is made.
