Legal Question in Family Law in New Jersey

Vacation during school year

My ex and I have a visitation order that allows him to have our son for up to two weeks during the summer. He chose not to take any of that time. Instead, he's trying to get a court order to take our son out of his new school for three days to go on a last minute vacation. Our student handbook specifically states that family vacations are not excused absences. Does he have ANY basis for a case here?
