section eight voucher

I am landlord in Middlesex County in New Jersey. I have not received a voucher for 2 months, since my tenants lease renewed. I was never notified until the middle of January that I wasn't going to receive a payment until February 1 and that I would receive 2 checks. I still have not received any payment from them. If I do not receive payment from the state, but my tenants have paid their portion, can I still file for eviction? Community affairs told me the checks are cut already and I would not be receiving a payment until next month. Do I have any recourse? I don't think landlords have any rights in New Jersey.

You cannot evict the tenant if sec. 8 does not make their payment. We serve a Notice of Claim on them, and then file suit to collect if they do not pay.
