Legal Question in Medical Malpractice in New Jersey

cataract surgery

during routine cataract surgery the doctor tore my iris from its socket. He said it was my fault since my head moved. I was under anesthesia and my head was in a harness. Where does the doctor assume responsibilty if I am under anesthesia?
