Tenant's rights

I am a single mom with 2 sons. I have been having financial problems since my ugly divorce in 1999. I have been renting a house since 12/98 and now the landlord just told me he wants to sell the house and I must be out in 3 months. Can he legally do that? I have been late in rent and am currently behind, but I do make a huge effort to pay as much as I can as often as possible.

What are my rights ?

Unless you have a written lease, he can give you 60 days to move out only if the buyer is moving in. Otherwise, he has to take you to court for non-payment of rent. If you have any other questions, contact Morris County Legal Aid.

If you have a lease, the landlord is bound by the terms of the lease. Otherwise, you have a month-to-month tenancy.

You efforts to pay may be morally sound, but they do not, in themselves, give you the right to hold over.
