Unlicensed & Speeding

I'm a NY resident stopped for speeding in NJ. Was going 86 in a 65 mph zone. Also, I never renewed my license which expired 2/03. Otherwise, I have an excellent drive record .. this is a first offense. I am required to go to court. How bad is my situation? How stiff will penalties be? Will I get points? Do I need a lawyer?

The Unlicensed Ticket 39:4-10 (a) or (b) could be worse than your speeding ticket. You should hire an attorney to defend you on both tickets. The speeding ticket carries 4 points (Check my firm's website regarding Motor Vehicle points at www.dasilvapinho.com/points.htm ) Depending upon the facts of your case, you may be able to downgrade the speed and get a point reduction which will save you money on your insurance (depending on the company). The Unlicensed should be amended to prevent a large fine and loss of license. You have a viable defense on the Unlicensed.

That is a 4 point offense. Depending on where it occurred (township) and who stopped you (state police or local), with competent counsel you could very well get it down to a 0 point offense.
