Legal Question in Workers Comp in New Jersey

injury at work

A friend of mine was hurt at work , he was on a electronic fork lift and when he backed up he wedged his hand between 2 objects, which then caused him to get 16 stitches in his hand. He saw the work comp. dr. and she said he could go back to work not even 24hrs after injury. ( To fold paper work ) But the emercency room dr. said that he should not go back to work for atleast 3-5 days. Is there anything he can do. like get a second opinion from his primary dr. The ER dr. also told him to take it easy for the simple fact that he could make things worse and cause serious nerve damage.... He is also taking Oxycodone and other pain relievers that unable him to drive to work. Can they send him back to work so soon after an injury, and can he get a second opinion from another doctor?

The only person who can authorize time off from work for a work related injury is the workers compensation authorized doctor. Your friend can get a second opinion from his private doctor, and take the necessary time off from work using sick days, and later on down the road he can TRY to get reimbursed for any sick days used. This usually requires the assistance of a lawyer who has filed a claim for you. I am an attorney who has handled many cases similar to this in various workers compensation courts throughout New Jersey in the past. It sounds to me like your friend has a very good workers compensaiton case and I believe that I could get him a monetary settlement for him through workers compensation.
