Legal Question in Business Law in New York
how do I go about getting back my money from a contractor who has not started the job after 2 months

Request the refund in writing, and if that doesn't work, you may have to sue the contractor. The terms of the agreement have to be examined and a two month delay may be justified.
Norman is right, if he does not return the funds you will likely need to institute legal action. We have substantial experience handling these types of cases, however, we would need some more information before making a complete and proper determination.
