Legal Question in Civil Rights Law in New York

Pro Wrestling's Struggle To Survive in NY

Hi I am a pro wrestler from NY. Recently the NYS Athletic Commission has been shutting wrestling companies down for not having a promoters license. The bond let alone for a license is $20,000. For one I don't believe pro wrestling should be governed by the Athletic Commission because pro wrestling is not a sport. It is entertainment due to the fact that it is pre determined and scripted. We have been fighting to have the commission removed from regulating pro wrestling but it is taking a very long time. The commission is using laws from 1920. I was just wondering if there was anything I can do legally to help with getting the NYS Atheltic Commission to stop regulating wrestling? I was also wondering if it were legal for them to be regulating something that is not a sport? Thank you and I hope you can help.

States have wide lattitude under their police powers to regulate industries within the state. There is no law stating that States can only regulate sporting events but not entertainment businesses. States have the right to license and right to regulate, so long as they do not interfere with interstate commerece.
