ebay truck purchase

i recently bid and purchased a truck on ebays internet site,i live in florida and the seller in new york,i sent a $1000.00 deposit then made arrangments to fly there and inspect and purchase,we arrived in new york to see truck and it was nothing as discribed,rusted,frame had been spliced together,not road worthy,hydralics not functioning properly,the picture posted on ebay was over 2 years old,(deception).seller refuses to return are deposit,we spent over another 1200.00 on exspences.truck has been sitting for 2 years,seller stated it was ready to put to work,it would take approxitmately 10.000.00 to make operational,what are my legal steps. thank you

First, if your check has not cleared, put a stop on it immediately. Second, contact a lawyer in New York to bring a suit on your behalf. Unfortunately, you will have to file a lawsuit in New York, not in Florida. You may find it more economical to just let it go for the $1,000 you have already spent than to spend much more to get your $1,000 back.
