Interstate Extradition

My husband was finger printed for a crime in NY. His prints came back to a possible match for a warrant in WV. He has been in jail for 17 days. They set bail for his offense in NY. In the mean time, he was notified that there was another possible match for the warrant in WV besides him. I posted bond on 12/24. How many days does WV have to come get him? I was told 10 days. He is waiving his right to an extradition hearing so we can get his name cleared in WV. Also, on this warrant, the DOB is not his nor is the last name (they are similar though). What are the chances of WV paying the expense to come get him even though they aren't sure it's him they want. I need him to be home asap otherwise we would let them hold the extradition hearing to see if it is even him they want.

Generally, your lawywer may be able to do the leg work to ensure that any dsicrepancies are cleared up and that he is released here, and not held any longer if he is not the person on the warrant in WV.

They very well may not extradite, due to the confusion... Ensure this is taken care of so he is released asap!
