Legal Question in Criminal Law in New York

Left a Treatment Program as part of probation violation

My brother was charged with a E felony and given probation for 5 years but he violated probation n was sent to a treatment center. He left the treatment center and is now waiting for sentencing. He has already served about 3 months in Rikers and I want to know how much time is he looking at? And is there any other possibilities that he may have? This is his first offense.

Re: Left a Treatment Program as part of probation violation

He needs a lawyer who really understands addiction and who can help the court to understand how failure is a part of recovery. HE is facing the whole bid right now less the three months served at Rikers.

There are many reasons people leave rehab. YOur brother might be a candidate for a different rehab, maybe he needs one on one counseling and other wholistic forms of counselling. HE may if he is using drugs need to go to a detox first.

THe only real way to know what to do is that he be 1000% honest with his lawyer and that the lawyer fight to get him what he really needs.
