Legal Question in Criminal Law in New York

non disclosure of felony on job application

if a job application form has a question, ''do you have a felony conviction'' is it an offence to write no or leave it blank or write not applicable if one does in fact have a felony conviction?.

is this a criminal offence?

could this be a probation violation?

I don't know that it will be an offense to omit but it is indeed based on what I read a misrepresentation and may come back to harm you later. It just does not seem to be a good idea. It may also later be proper grounds for termination.

Re: non disclosure of felony on job application

While not a criminal violation or even a probation violation, it is grounds for termination if discovered at a later date.

You can do something about this problem. You can have your criminal conviction 'sealed'by court order. Then you may, without fear, respond 'no' to all of these questions.

It is a simple and inexpensive motion and I can easily assist you.
