Legal Question in Criminal Law in New York

record expungement

Hi, We live in middlesex county, New Jersey. When my husband

lived in Brooklyn, NY he was charged with and pled guilty to 2nd

degree assult and received 5 yrs probation, which he successfully

completed. This was thirteen years ago and now he is applying

for jobs in NJ which require background and fingerprint checks

and is failing because of this old charge. He received a letter

saying he is ''relieved of this'' but it still comes up during these

checks. How does he get it removed completely? thanks!

Re: record expungement

If the charges were heard in NY then expungement must be done with a NY attorney.

Re: record expungement

At present there are only 2 ways: a presidential or gubernatorial pardon. Even then there remains a good likelihood that not all agencies will remove the information.
