Legal Question in Criminal Law in New York

statute of limitations

I know somebody that has a class D felony in New York State. I swear its not me, I am leaving my name. He has been away for a number of years and wants to know if there is a statute of limitations on any warrant he may have.

If a warrant was issued then most likely

it has not gone away. You friend should

contact an attorney to discuss the nature

of the charges and possible ways to resolve

this issue. Your friend may contact my office

for a confidential free consultation with an attorney.

Re: statute of limitations

ABSOLUTELY NOT! a warrant is not like a criminal charge, where legally and constitutionally you have rights which are protected, these rights in NO WAY extend to warrants... however, if he turns himself in it may be possible ot simply expunge the warrant and finish up with the case with reasonable dispostion that he can live with...

the warrant will remain permanently on his record and as a result he may be pickedu p on it at any time, or if pulled over even in another state the warrant may show up, he could be arrested, and held then transported back to new york.

if your friend would like assistance with clearing up this warrant have him contact us at 212.709.8303
