Legal Question in Criminal Law in New York
Welfare fraud
I am being charged with welfare fraud because I never notified them I got married so they continued to pay the premiums for me for almost two years. I got a letter saying that since I didn't recertify that my coverage was ending effective 9/2006, which is why I didn't think I needed to report my marriage to them. How can I be held responsible when I recieved a letter telling me my coverage was ending? Also, the officer told me to have $2000 (the amt owed) when I go to court for bail money. Will they really put me in jail, I have a very young child and a newborn baby?

Jail is always a possibility. It is critical that you have legal representation. If you need an inexpensive lawyer, let me know.
Re: Welfare fraud
You should speak with a criminal defense attorney right away and not make any statements to the police or anyone else. Please feel free to contact my office if we may be of assistance.
Re: Welfare fraud
Welfare fraud is a felony. Yes they could put you in jail or hold you on bail. You would do well to prepare for that by getting to a lawyer. While a sentence of jail is unlikely (probation is more likely) it is a possibility. Best to prepare for the worst while hoping for the best.
I hope you kept the letter because it makes your claim plausable. Please find a lawyer if you can afford one. If not, do not speak to anyone about the case until you get to court and then ask that a lawyer be appointed to you.
