Legal Question in Family Law in New York

Child support with NO visitation

I have 2 2 boys but I have NOT had any visitation with my younger son in about 2 1/2 yrs. What options do I have in my paying of support? Can I cut support in half?

Re: Child support with NO visitation

You are required to support your children whether you visit with them or not. You do not have the right to reduce your child support payment based upon contact with the child nor are you allowed to reduce your payment with out permission of the court if there is a support order.

Child Support is based upon the parents income and the needs of the child. Best interests of the child is the standard that governs in this situation.

Re: Child support with NO visitation

The two are mutually exclusive. Your visitation rights or lack thereof has nothing to do with your obligation to pay child support. I suggest that you contact a lawyer and file a petition for joint custody.
