Legal Question in Family Law in New York

NYC Child Support

I have 2 kids, from 2 different mothers, and I am paying the same for both? Should I be paying a total of 25% and not 17% for each. In addition, when my second child's mother was not working, the state indicated that I would have to pay child support. She is now working, and has been for 2 years, making double what I make, but the payments have not been adjusted. What do I do? I can't seem to support my new family, and am thinking about filing for bankrupcy or selling my house to get out of debt. I am not in arrears, so I am thankful for that. Can you help, or tell me what I can do?

Re: NYC Child Support

The custodial parent of each child is entitled to support independently calculated in accordance with the CSSA guidelines, which is 17% for one (each) child. However, that does not necessarily mean that each gets the same amount. The fact that your second child's mother has found employment since the order was entered does not diminish your obligation; in fact, it could increase, for example, if she is paying for child care so that she can go to work. Contact an attorney to discuss the details of your case.
