Legal Question in Medical Leave in New York

intimidation

i recently completed 2 months of leave to attend a rehab center due to an eating disorder. Upon my return, my employer stated that they do not think its in my best interest, nor the firms best interest if i return to the firm. They have offered me a severance pkg with a termination agreement. Do I have any recourse?

If you were out on the Family Medical Leave Act then an employer does not have the right to terminate you for taking the leave. I suggest to you speak to an attorney to discuss the specifics.

Retaliation for exercising your legal right to Family Medical Leave is illegal. That being said, if you think it's in your best interests to move on, you need to negotiate the best possible severance package.
