Legal Question in Immigration Law in New York

I married my current husband on Sept 2009. His immigration status is currently illegal. I would like to find the best effective way to start proceedings for him to obtain his residency since I am a US citizen. In the past he has dealt with many lawyers to appeal his case since in the early 2000's he was arrested by immigration and payed a 10K fee of some sort in order to stay in the states with a court date he never attended. In the past his appeal was denied and because he can no longer afford lawyer fees that was the last process done. I have heard many times that he will have to go back to Dominican Republic while I start proceedings here, but I think there can be a more effective way to legalize his status, and thats the advice I am looking for?

Most likely, your husband was already ordered deported (when he failed to attend a hearing in Immigration Court). He must consult and hire a good and knowledgeable immigration attorney before you file anything at all on his behalf.

There is no any effective or cheap way to make him legal. It will be a hard battle to win, and you need legal assistance. This is not a situation where you can do it yourself.

Should you file a petition for him while he is still in the US please be advised that when his personal data comes up during a search that immigration will conduct immigration will look for him if the court matter is still outstanding.
