Legal Question in Employment Law in New York

Union failure to represent

I as criminally charged and placed on suspesion from my job 1 1/2 years ago following an investigation. Since then the charges are dropped and throughout that time my union has done nothing about trying to arbitrate the matter. I was recently told by a rep that the time has lapsed for them to do anything.

Can I sue the union and my employer for my wages being lost?

Re: Union failure to represent

I am not sure that they can be sued if you didn't keep them informed, but you can sue the people and the police that caused the problem to begin with, through a federal civil rights action.

If you are interested in such a suit, and would like to speak to me about representing you on that case, contact me through the links below. We will look into the other potential cases as well.

Good luck
