Legal Question in Personal Injury in New York
my insurance company wants to interview me--in person--regarding a single car accident. I hit the guardrail, no other parties involved. However, my passenger who had a warrant out for her arrest--which I was unaware of--got nervous after the trooper asked some simple questions like your name and birthday--then the trooper asked me what her deal was...what was she hiding, basically. Then he said he would find out via his database in car. She then asked for an ambulance to avoid the consequences--and the trooper confided in me that all though he knew she was trying to get away from him, By law if someone asks for an ambulance he has to call it in. So, he just followed the ambulance and arrested her there--I assume. My question is: what should I do to prepare for this face to face interview? Why would the insurance company send a rep from miles away to interview me in person? Should I have a lawyer present? Would they test me in some manner--urine or drug wise?

Yes , you should have a lawyer. While they may only be interested in her injuries, what you say may have criminal ramifications.
The reason why they want to interview you is that there are certain provisions in your insurance policy which they could disclaim your benefits (like drug, alcohol, engaging in criminal activities etc.). It probably would not be a bad idea to call a local lawyer and ask them to review your policy, go over your story and represent you during your interview. You do not want to get disclaimed.
Have a lawyer beside you when answering questions. Best, M. E. Zuller
