Legal Question in Personal Injury in New York

How much is this worth?

An airport limo driver tried to detain me due to a discrepency in fare. I had contracted for a $29 fare and he had been informed that it was $40. When I tried to go to a pay phone to call the company, he grapped me and then got into a tug of war with me by yanking my bags as he tried to put them in his trunk. I heard his dispatcher tell him to take my bags. After a 25 minute tugging match, I managed to drag him and 4 bags into the airport and called the car company who told me that I had to pay $40. I paid it and barely made my flight. Later they told me it was all a mix up. My bag was ripped, I had blisters on my hand, I just made my plane (all sweaty), I was illegally detained, assaulted and publicly humiliated (as people yelled at me to pay him his fare). Finally, it is possible that I have a torn muscle in my shoulder. I am going for an MRI tomorrow. I am planning on suing the car company, the dispatcher and the driver. Any thoughts?

Thoughts...your tug-o-war could have been avoided by calling a cop..therefore you will have some contributory negligence should you decide to sue.

As for the torn shoulder, a doctor must relate this to the incident itself for you to be able to recover. Then the case might have some value.

Also, report the matter to the TLC, even if not a yellow cab, if it was in NYC.
