How do you know it is on your property line? The first thing you should do is get a survey of your property.

Assuming the fence violates the property line, the next thing you should do is send a letter (certified) to your neighbor - together with a copy of the survey - requesting that he or she moves the fence to his or her own property.

If that does not work, the next thing you should do is file a complaint with the local building department since the fence is in violation of the boundary line.

Finally, if that does not work, you may commence an action to remove the fence and for damages.
