Accountant misfiled my Income Tax

My accountant filed my 2004 taxes incorrectly.I am a resident of NY and he did not submit a NY tax return (did NJ instead b/c that is where I worked). I just received an audit in 2008 stating that I owe NY State income tax. Am I responsible for the interest and the penalty when my accountant submitted the wrong state as my resident? I gave hi all the correct information and he just thought I live in NJ.

I think that you will find very little tax to be due. The New York income tax is reduced by a credit for the tax paid to New Jersey with respect to your NJ source income. You should get a refund of some NJ tax.
