Legal Question in Tax Law in New York

I am presently married but looking to file a legal separation. My question is this: My husband recently became an over the road leased owner operator trucker. Which means he is basically self employed and has to do his own taxes as they are not deducted from his paycheck. My concern is if we are only legally separated and he does not pay his taxes, can they then come after me? Or is the only way to protect myself financially is to divorce him? Thank you

With few exceptions, which probably not apply to you, you are not responsible for your husband's income tax obligations unless the tax arises out of a joint income tax return which you had signed.
