Legal Question in DUI Law in North Carolina

my brother was drinking at a friends house right down from his on his way over there he ran out of gas, then he was pushing his moped home that was out of gas, he was jumped by 3 guys that tried to take his moped an wallet from him. he was hurt pretty bad . when the police and ambulance got to him they carried him to hospital were he spent 2 days he was given a citation which we werent shure what it was for? 6months have passed the police man droped the citation and said he had no evidence. but now the DA wants to charge him with a level 1 dui can the da do this?hes on disability and has very little money what are his choices? an should he appel it to superior court? thank you david g.
