Legal Question in Immigration Law in North Carolina

legal alien

I have a question about my fiance who is a legal alien in the U.S from Haiti, last here he was convicted and sentence to a correctional center for 10 years, since he was not an American citizen, after serving his time he was told that he would be deported to Haiti after he serves his time my question is since I'm an American citizen if we get married before he got of jail will he be able to stay in the country or should we hire a lawyer to stop the deportation from happening. All of his family is in this country and I feel like he is a change man and after he serves his time why can't they allow him to stay here. He is talking about opening up his own business after he serves his time and for them to send him back to his country where he doesn't have anyone is not right. Can you give me any advice about this situation! Is there immigration lawyer you can refer me to so I can get this thing going! Thank you for your time!

Re: legal alien

First, you have to recognize that the man has been convicted of a FELONY. A 10-year sentence tells me that it wasn't for jaywalking.

You can marry him if you like, but that's not going to stop deportation. Marriage visas are not granted to convicted felons. You can aask a specialist, but I suspect that's not going to help him.

I think the only chance you have is to win an appeal and have the sentence vacated, --short of that, consider moving to Haiti.
