Legal Question in Real Estate Law in North Carolina

Deed/Real Estate

I am divorced. I own a home. The mortgage is in my name, the deed is in my name and his. My ex has disappeared (he is an illegal alien). I can't refinance or sell. How can I get his name off the deed?

Re: Deed/Real Estate

If this was something addressed in the divorce decree, then you may be able to file something and have the judge transfer the property to you. Speak with your divorce lawyer.

Otherwise, contact a real estate litigation attorney. You may need to file a partition action.
