my husband died without will we have two children and a grandchild do i need to get a attorney

I don't know if you need an attorney or not but you may want to consult with one. There are many facts that you would need to elaborate on. You may need to open an estate in your County. Essentially by not having a will, everything will be split between you and the children (not the grandchild if he or she is the grandchild of a living child). However, you may also have property that automatically passes to you depending on how it is titled or what the beneficiary designation is, etc. As an example, if you own a home and it is titled in both your names as husband and wife, then you are the sole owner.
