Legal Question in Disability Law in Ohio

Workers Compensation/FMLA/Unemployment

We have an employee at work that is currently a Workers Compensation case. She now has injured herself again, but not same injury as Workers Comp. claim. She got a doctors excuse to be off the next 30 days, so we sent her FLMA papers to fill out. She then went to Unemployment and is filing for this. Can she get unemployment compensation when we are offering her work? I thought you can only receive unemployment if you have been fired. She hasn't even quit. We offer her a position to just answer the phone.

Re: Workers Compensation/FMLA/Unemployment

If you fight the request for unemployment, she will lose. It sounds like she's really trying for some sort of a disabilty claim.
