Legal Question in Credit and Debt Law in Ohio

Collection Agency Tactics

Received a phone message from a woman, describing herself as a ''special investigator'', and left a phone number, stating that I needed to call her regarding a civil AND criminal case pending against me in a local county court. Called her at this number, when she informed me that I was going to be taken to court regarding a debt from 1993, that was ''renewed'' in 2000. She told me it was from some kind of finance company. I do NOT remember this debt. I asked her if she could send me documentation regarding this debt, she stated that she does not do this, that I will be shown documents in court. I then said well I am not paying money for a debt of which I , at this point, do not remember! She then said,''fine, the county sheriff will be coming to see you at your job and home.'' (and hung up on me)I am curious as to my rights here- especially considering the message that this was a ''criminal'' case ( it is not), the fact that she refused to provide me any documents regarding this debt, the fact that she never once identified the company that she was working for, the fact that she threatened me with the statement that ''the county sheriff was going to be coming to my job and home''. I can not believe the meaness ! Please advise...

Re: Collection Agency Tactics

This agency has definitely violated the Fair Debt Collection Practices Act. You should also check your local court dockets to make sure that nothing is filed against you. The debt may still be valid, as the Statute of Limitations on a contract, as a credit card is, is 15 years.
