Legal Question in Family Law in Ohio

Mother in Contempt of Court Order

Do we have a leg to stand on when non-custodial father (me) pays 100% child support and claims child on income taxes (according to court order) and the mother (custodial parent) still files her taxes and claims the child? This is in violation of our court order. This delays our taxes and red flags us with the IRS. I am current with child support, never been in arrears. Was not married to mother. Mother has just submitted a request for review of child support to be increased from $400 to $650 per month for one child. Need help with the income tax problem as soon as possible. Certainly if I was in contempt of the order by not paying the support I would be in big trouble. Mother was on welfare. Frauded welfare system and is now employed. Please help! Thank you.

Re: Mother in Contempt of Court Order

You must file a Motion to Show Cause in Contempt against her immediately, and also contact her welfare case worker, and report the alleged fraud.
