Legal Question in Family Law in Ohio

visitation

My father passed away on july 1 2007. Before he died he gave my sister power of attorney over him,it was also given for my mother whi was not in her right mind due to a recent stroke. My sister has now moved my mother out of a nursing home into her home. She refuses to let me see or talk to her. when she was in the nursing home the staff was told not to let me see or talk to her. She has her in a adult daycare while she is at work. She has told the staff there the same thing. My mom has no clue as to what is going on. I spoke to my mom at the funeral and I related this to her and her reply was I could see her anytime I wanted. Is there something I can do so I can see my mom again?

Re: visitation

A power of attorney is generally revocable in writing at any rime by your mother, but the practical chances of that are slim. In the absence of that, you might want to file an applivation for guardianship for your mother in the local probate court. The court will better be able to monitor proper access to your mother, and look out for her best interests.

Re: visitation

You may have to seek a court injunction that allows you to visit your mother. You might also contact Adult Protective Services in you area and explain your situation to an intake social worker.
