Contract

I signed for $5000 loan for a ex-

girlfriend's braces. I wrote out a

contract and had it notarized, saying

she would make the monthly

payments on time. We broke up and

she has not made the payments on

time once in six months.

I'm worried about the negative effect

this will have on my credit.

Is our contract legally binding

Can I take her to court? If so how do

I begin?

You are right to worry about the non-payment hurting your credit. If the loan gets sent to collections, it will likely be reported to the credit agencies who will place it on your report since the loan is in your name.

In order to say anything about your written contract, I would have to look it over. Even if it is not valid as a contract, you might still have an oral contract with your ex-girlfriend. The task then would be proving the oral contract was made and that she breached it.

Your first step in the matter would be to contact an attorney to look over the contract for you. Since the loan is for $5,000, this matter will be in municipal court. If you decide to file suit against her, having a lawyer on your side can help you in the process of filing a complaint and proceeding through the lawsuit. Much like you seek help from a doctor when you have a medical problem, a lawyer is the best person to help when you have a legal issue.
