Legal Question in Civil Litigation in Ohio

political subdivision immunity

i was pulling out of a parking lot .i was hit in the face by a stream of high pressure water from a fire hydrant opened by fireman. it caused whiplash. the city is trying to claim they have political subdivision and cant be held liable. is this true or is there immunity from this because the fireman acted in a reckless manner. can the city even use this to get out of being sued?

Re: political subdivision immunity

Generally, a political subdivision such as a city is immune from personal injury and property damage suits against it. There are some exceptions, but since the injury was a result of the fire department performing a normal fire department duty, the exceptions probably won't apply.

If the firefighter was acting recklessly in opening the hydrant, you may be able to bring a suit against him personally for your injuries.
