After layoff can I change to H1, Part 3

Thanks for the first answer:

we were thinking that my wife (who is already studying here) would transfer on a student visa and myself &our daughter either on a dependent student visa or tourist visa.

I got the information from my company lawyers that the submission of the application is already sufficient to stay in the US (as I have only 4 - 8 weeks time now till the L1 is gone and my layoff is know to the government). Is this correct?

You can change to H-1B only if you applied prior to the applicable H-1B quota running out on April 3rd or April 30th. Otherwise, you will need to wait until next year if you can find an employer. You can stay in tourist status for a very limited time (possibly one year). F-1 status is expensive since your wife must pay the school full-tuition.
