visa status

I would like to help one of friend who is sponsored by J-1 visa and applied for the green card just before visa status will end, but his case file was not on time and he became out of status like 4 months. How do you think this situation will be clear up? Thank you for your time

Re: visa status

You have not provided sufficient information to answer this question. You will need to provide information about how he is being sponsored for permanent residency (employment or family), whether he is subject to 2 year return home rule for J-1 visas, how he fell out of status, etc. For example, if he is obtaining permanent residency through employment sponsorship, then being out of status by only 4 months is not a problem. He needs to make sure that he does not fall out of status for more than 180 days. Otherwise, the 3 year bar for a visa applies. Please provide a detailed description of his situation.
