Legal Question in Legal Ethics in Ohio

Time Requirement for Attorneys to Keep Closed Client Files.

What is the length of time attorneys are required to keep client files after their case has settled and the file has been closed? Does the client have to give attorney permission for their file to be destroyed even after the required time has passed?

Re: Time Requirement for Attorneys to Keep Closed Client Files.

I don't know of a hard and fast rule about how long to keep files. Most attorneys might go through clients' files and throw away extraneous papers, but the heart of the file should be kept for at least several years. Further, an attorney should not destroy a client's file without notifying the client. However, some attorneys advise clients in letters of engagement or representation how long they will keep client files. Before complaining, make sure this is not your situation.
