Contractor paid for work not done

I recently acquired a building that had an escrow account with draws for a contractor to perform work. The contractor has received over 30,000.00 and when the property was inspected it was found that he had either done none of the work or done the work improperly. I live in Ohio he lives in Indiana. How to I place a lien on him to get my money?

Dear Vexed Property Owner:

You maty have to file suit against this contractor, with claims of breach, fraud, unjust enrichment, conversion (civil and criminal), and perhaps even violations of Ohio's Consumer Sales Practices Act which provide for treble damages!

The important question is: Is he collectible?

The proper court venue (location) is the county in which the real property is located.
