Dumping Sewer Waste

My neighbor, a part-time sheriff, put in a septic system without a local septic permit and drained it into a farm tile. The farm tile has broken down and now there is septic waste coming up out of the ground and laying on top of my property. I notified the Health Department and they said they can do nothing. Do I have any rights to protect my property from his septic waste dumping?

You can sue him for negligence and nuisance for damage to your property and its enjoyment by his activity. His lack of use of a proper permit is evidence of his negligent conduct. You should go after him in common pleas court.
