Re: give house to wife?

Dear Generous Spouse:

You certainly may deed your house to your Wife, HOWEVER, in Ohio, such deed, unless done properly, may not eliminate the almost automatic dower right of a spouse to 1/2 of the real property. That right is statutory in Ohio. Dower may be overcome with a proper deed that contains a provision waiving right of dower.

Depending upon your real desire, you may also consider the Transfer on Death deed form. Ask an Attorney.

I respectfully suggest you contact a reliable, exp[erienced real estate attorney to assist you in obtaining the result you desire, and to prepare a proper deed document for recording. The cost may be very reasonable and well-warranted to achieve the proper result you desire.

Good luck.

Sincerely,

J. Norman Stark, Cleveland, Ohio.
