Legal Question in Real Estate Law in Ohio

leagal right to recieve rent

I was evicted with a 3 day notice. I moved out on May 3 2002. Since my landlord evicted me, does he have the legal right to recieve rent for the entire month of May.

Re: leagal right to recieve rent

Under Ohio law, a tenant is responsible for the rent on the remainder of the lease if her or she has been evicted. This is true whether it is a month-to-month lease or written term lease. The landlord, however, has a duty to mitigate his damages, which means he must make attempts to relet the premises.

I don't know the type of lease you have, but even under a month to month, if you occupied the premises until May 3, you are responsible for the entire month.
