Legal Question in Traffic Law in Ohio
Traffic Ticket
I got pulled over and the officer cited me, but he forgot to give me the copy of the citation. I called and the clerk confirmed that the officer forgot to give a copy of the citation. Of course they want to come and pick a copy. Is they a way I can use this mis-sight to my advantage to fight or get out of this ticket? Is there any legal issues with this?

If you don't pick the ticket up, they'll just bring it to you. I really don't see any legal issues here that will help you get out of the ticket.

If you are not served with the citation in a timely manner, then the case can be dismissed. In addition, the citation must be served by the officer that stopped you. My firm has successfully argued this in DUI cases (amazingly enough there is a local jurisdiction that had one officer who did not provide the offender with the citation as "a matter of department policy" or so he thought...).
