Legal Question in Wills and Trusts in Ohio

Sale of house

I am the executor of my father's estate. My brother waived his co-executor responsibilities. Can he change his mind?

My father signed a Quit Claim Deed a few years ago with my two brothers and myself as recipients. They are now refusing to sell the house. Can I do anything about this?

Re: Sale of house

You and your brothers are tenents in common, meaning that you all have an equal share in the property. If the other two refuse to sell, you could file an action in partition. The court would appoint a commissioner to appraise the property, sell at auction and distribute the proceeds to the tenents.
