Legal Question in Military Law in Oklahoma
AWOL from National Guard
If a member of the National Guard goes AWOL before they have been to basic training, they simply fail to appear at their pre-basic training drills (Recruit Sustainment) are they technically AWOL? If so, are they discharged for is there a warrant put out for their arrest? Could they face jail time?

Re: AWOL from National Guard
AWOL is serious misconduct and can result in arrest and prosecution. AWOL beyond 30 days can effectively be desertion. Although the national guard is not the same as the Army, the failure to report to basic training could be very serious. There would likey be a warrant, and there would likely be serious consequences for failing to comply with military orders.
The NG member should consult with the a JAG officer and determine the best way to mitigate the problem, and should act with immediate haste in doing so.
