Legal Question in Consumer Law in Pennsylvania
Delivered oil to wrong house - ours
On Friday an oil company, not ours
pulled up and began to put oil in our
tank. My wife and I were both home
at the time and my wife ran out and
stopped the guy and directed him to
the correct house- #9 Dunkin
instead of #2. Our #2 is on our door.
A short while later I got a call from
the oil company as to where to send
the bill. I said don't send one, it is
your mistake. They said they put in
33 gallons and a bill arrived today.
What do we do and where do we
stand legally. Do I have to pay for
their mistake?

It is probably too small an amount to argue about in court but I think if it went to court, even though it was their mistake, the court would probably rule that you have to pay the fair market value for the oil. That means the amount that the oil company paid for the oil, not the amount of the bill. But some courts might look at it differently. Still, it is a small amount and you should probably try to work it out with the oil company.

Well, when you call the oil company, find out what employee did the service. He should clear it up. If they send you a bill, make a copy of it, and prepare a letter to the oil company with ALL the relevant information, numbers, facts, accounts, etc. Look online and send the letter both to customer service and also to management/headquarters simultaneously. You should definitely get a response.
